Terms of Service

By using the services provided by Finqu, you agree to these terms. Last updated 13 October 2021.

1. Application and validity of the Terms of Use

These terms and conditions apply to Finqu products and services delivered by Finqu Ltd (FI27641772) (hereinafter referred to as the Service Provider) to its Customers. These terms and conditions will come into effect on 1 December 2016 and will remain in effect indefinitely.

2. Creation and transfer of the contract

The agreement is created when the Customer registers to Finqu's service via the website or resellers. The Service Provider has the right to transfer the contract and/or services to a third party and to change the content of the contract and/or service description. The Service Provider has the right to disclose the information required by law to the authorities.

The Customer has the right to transfer the contract to a third party by changing the contact details of his Finqu account. The Service Provider reserves the right to reject the transfer of the contract.

3. Term and Termination

The contract period of the service is always one calendar month. The Terminated Service Agreement expires on the last day of the month of termination, after which the account will be closed, and all information in the account will be deleted. The notice period is the current calendar month.

Possible vouchers and other benefits are not convertible into cash.

The Service Provider reserves the right to terminate the service immediately without notice if the customer has violated the contractual terms or the hosting of the service cannot be continued (e.g., force majeure situation).

4. Delivery of the ordered service

The Service Provider reserves the right not to deliver the ordered service without a separate mention, or reason, or notification.

5. Content and production of the service, rights, and obligations of the Customer

The Service Provider may provide the service in accordance with the contract in its own way. The Service Provider reserves the right to change the content of the contract and the service. Changes made at the request of the Customer may be subject to a fee in accordance with the general price list of the service provider.

The service provider applies for an SSL certificate through registration services maintained by third parties. The Service Provider only acts as an intermediary in the registration and registers the services with the information provided by the Customer. The Service Provider is not responsible for third-party registers or services.

The Service Provider provides the online store with a free web address of the Customer's choice in the domain it owns (for example, yourshop.finqushop.com). The Service Provider reserves the right to reject and delete the address chosen by the Customer, after which the Customer will be offered the opportunity to choose a new free address. The free web address and domain name are the property of the Service Provider.

The Customer is responsible for the material uploaded to the service and for ensuring that the added program code does not expose the service or server to attacks, data hacks, or similar activities, and the material is not offensive to anyone or contrary to law or good practice or exceeds the resources reserved for the service. The Service Provider reserves the right to remove material or program code if it considers that the material violates these terms and conditions.

The Customer is responsible for ensuring that his/her activities on the information network comply with the law and good manners. Unauthorized use or attempted use of the Service Provider's or third parties' servers and services is prohibited. It is strictly forbidden for the Customer to search for and misuse potential security holes, and will result in immediate termination of the contract and possible claims for compensation.

If the use of the client's server resources is larger than that of a regular Finqu client, the service provider has the right to revise the price charged for the service to match the use. The Service Provider reserves the right to prioritize transport in such cases.

The Customer has reserved server resources for the number of products in the selected Finqu plan, as well as 50 gigabytes of disk space for their product images and attachments. For larger resources, the price corresponding to the use must be negotiated with the service provider.

The Service Provider's liability for hosting the services is limited to the amount paid by the Customer for Finqu services during the previous 60 days. The Service Provider shall not be liable for indirect damages that the Customer may suffer for technical or other reasons.

The Service Provider reserves the right to prevent, by technical means, activities that are in breach of the contract.

Under no circumstances may the Customer reveal the user IDs of the service to a third party. The Customer is responsible for all activities carried out with his/her IDs.

The Customer is responsible for the services, goods, delivery of goods, and other matters related to online sales and sales. The Service Provider is under no circumstances responsible for the Customer's trading or other related activities.

The Service Provider reserves the right to temporarily suspend the hosting of the service if necessary for repairs, maintenance, or other work. The Service Provider shall endeavor to minimize the duration of the interruption and to inform the Customer thereof in advance if possible.

The Service Provider shall not be liable for errors or outages caused by force majeure or human error or by actions of a third party.

6. Usernames and passwords

The Service Provider reserves the right to change the username and password if necessary by notifying the Customer.

7. Payment and pricing of the service

The Customer pays monthly for the use of the service in accordance with the ordered services. 

The current price list can be found on the service's home page (www.finqu.com). The Service Provider reserves the right to change the prices of the services, the service plans, and their content. Changes in service plans and prices will be announced on the homepage at least 30 days before the changes take effect.

8. Termination and Termination of the

Service The Service Provider has the right to close the Customer's access to the Finqu account and to initiate the termination of the service if the Customer has two open monthly payments unpaid.

The Service Provider has the right to terminate the Customer's service without notice if two monthly payments are due at the same time, the Customer violates the terms of the contract.

In the Monthly Free Plan, the Service Provider reserves the right to initiate the termination of the Service if the Customer has not logged in to the Service for a continuous period of 3 months or no sales transaction has occurred through the Service for a continuous period of 1 year. The start of the process is notified to the e-mail address set by the Customer for the customer account, and the process can be interrupted according to the given instructions.
